If you are served one of these yellow pieces of paper that reads “Civil Summons” by your county sheriff, or perhaps you received one in the mail, then I regret to inform you, but you are being sued. There should be another document attached to the yellow summons that is titled “Complaint.” The Complaint is the “lawsuit.” The Complaint is the document that sets out the facts and allegations that the plaintiff believes are sufficient to support a legal claim against the defendant.
If you are the recipient of a yellow summons, then you are the “Defendant” in your lawsuit. The Plaintiff is the party that sent you the yellow summons and attached complaint.
Once you received your yellow summons, and the attached lawsuit, you are officially on the clock to submit a response. The North Carolina rules of Civil Procedure dictate that a defendant must submit a response to the plaintiff’s complaint within 30-days of receiving the summons and complaint. Doing nothing, e.g. not responding to the complaint, will likely result in the Plaintiff obtaining an Entry of Default Judgment against you. i.e. the Plaintiff automatically wins if you do nothing.
